Bath and Shower Enclosures

The standards, terms, and conditions stated herein apply to all products provided and all work performed by Whiddon Glass Company, Inc (the Company) for the party or parties (the Purchaser) that have contracted with the Company for the purchase of said products and work. These standards, terms, and conditions constitute Company policy and serve as a binding agreement between the Company and the Purchaser as of the date of their publication and further are subject to change at any time without prior notification. The Purchaser is advised to have the most recently updated set of standards, terms, and conditions at the time of making any purchase from the Company which will remain in force for said purchase regardless of any changes in Company policy, thereafter. Standards

Purchases

All Company shower doors and enclosures are custom ordered and fabricated exclusively for a singular opening in accordance with the requirements of the Purchaser and cannot be used for any other opening. If the Purchaser intends to cancel their custom-order purchase, they must contact the Company directly within 24 hours of said purchase both by telephone and by email to the Company telephone number and email address. Following these 24 hours, and once the glass has been ordered and the fabrication process has begun, no cancellations or refunds are eligible, and the Purchaser is obligated thereafter to receive and pay for their custom-made bath or shower enclosure or door.

Glass

Glass is a man-made product. All glass has a greenish hue or tint due to the iron content in the glass. This greenish hue can vary due to the size and thickness of the glass. Low iron glass has a lesser greenish hue and can also vary due to the size and thickness of the glass.

In addition, every piece of glass contains various types of flaws or blemishes, which may be invisible to the naked eye. Even the best glass available on the market will contain minor defects.  The federal government mandates that no defects should be visible in the glass when it is viewed vertically or horizontally from 11 feet away under normal lighting conditions. All glass provided by the Company meets or exceeds this standard. In accordance with this standard, the remaking of any glass due to these normal blemishes will be based solely at the discretion of the Company.

The glass manufacturing industry and the Company have established an acceptable level of cutting tolerance allowing for all glass sizes to vary within 1/8″, plus or minus. If glass ordered by and for the Purchaser is within this tolerance level, the Company will not be responsible for any remakes, whatsoever. Vertical gaps on doors may vary from 1/16″ to 3/8″ depending on the configuration. All pivot or wall mounted doors will typically have a 3/8” to 1/2” gap on top and bottom. Vinyl seals are available free of charge only at the time of purchase or installation.

The Company will design and install your unit with a “tight as possible” installation. Please keep in mind, glass cannot conform to contours, bellies, bows, uneven tile, nor any sub-standard workmanship performed by any other contractor.

Federal, state, and local safety codes further mandate that shower enclosure glass must be tempered safety glass. Tempering is a process by which the glass is heated to a very high temperature and rapidly cooled resulting in increased strength. “Tempered Glass” logos may appear in any corner of the glass. Warping of glass is common and may occur during the tempering process.

In general, all of the glass provided by the Company will remain within accepted industry standards and guidelines. Further specifications are available upon a written request from the Purchaser.

Terms

Delays

The Company is not liable for any delays due to 3rd party carriers, lost shipments, acts of God, weather, machinery downtime, loss of internet connection, out-of-stock glass or hardware, or any other unforeseen event out of the control of the Company. The Company will do its best to notify the Purchaser informing them of any delays and will give the Purchaser an exact or approximate delivery time. 

Installations and Repairs

The Company will not be responsible for the structural integrity of any wall or other mounting surface. The Company will not assume any responsibility for cracked surface material due to installation or removal of existing enclosures. All units require hole drilling in tile, marble, granite, and other material. In some cases, notching of bullnose or decorative border tiles may be necessary. Tile notching is the responsibility of the homeowner and/or tile contractor, not the Company. Also, on occasion, we may need to drill into cast iron or fiberglass tubs to safely secure the unit. With glass tiles, the Company may recommend drilling through grout lines only to secure an enclosure. On occasion, porcelain, ceramic, and glass tiles may crack or break during drilling. The Company will not be held responsible for the repair or replacement of any tiles that crack or break due to normal drilling.  Any tile or surface damage that may occur during the removal of an existing unit or the installation of a new unit is to be remedied by the Purchaser at his or her expense.

Regarding the retainment of water, it should be noted that opening an enclosure door outward may result in water running down onto the bathroom floor. Further, please keep in mind that a frameless shower enclosure is made to deflect water, not retain it. They are not designed to be 100% watertight and leak-proof.In addition, shower bases and tubs with an incorrect pitch or slope can cause water damage. Incorrect pitched sills and thresholds may drain water onto the outside floor. A threshold dam will be installed by the Company under any door where the curb is pitched incorrectly or off-level towards the outside of the enclosure. If the Purchaser refuses this threshold dam upon the initial installation, the Company will charge a service fee at a minimum of $125.00, plus the cost of material, to go back and install one after the initial installation has occurred.

Correctly built stalls following quality construction standards will eliminate most of the above problems. Although the doors and enclosures are manufactured to fit given sizes, there may be steam or water leakage, especially in a direct spray situation. The Purchaser is to take into consideration the positioning and aim of the showerhead(s), water pressure, body sprayers, and any detachable shower sprayers. All glass will be centered on the shower base curb or tub, unless otherwise specified in writing by the Company or Purchaser. Glass hinged doors swing in and out unless the layout of the opening dictates otherwise.

The Company will assume no liability due to unforeseen conditions such as drilling into pipes that are hidden behind walls where drilling is necessary. The Company requests that the contractor or homeowner notifies the Company before drilling if a pipe is in the area where a hole is needed. The Company will redesign and work around a pipe if notified before design and installation.

If the Company’s representative arrives at the Purchaser’s location for a pre-scheduled appointment and the Purchaser or representative fails to appear at the scheduled time, the Purchaser will be charged $125.00 for restocking and/or rescheduling.

If an existing enclosure must be removed, the Company will not be held liable for any damage to walls, tiles, furniture, or any other items in the bathroom while removing the enclosure. The Company will attempt to cover any existing holes that were hidden behind the old existing framed enclosure. However, due to pre-existing conditions and configurations, this may not always be possible.

After removing existing enclosures, the Purchaser may see discoloration or stains on tile, grout, marble, granite, or other surfaces. The Company will not be responsible for removing any such stains or discoloration following the removal of said enclosure. The Company will dispose of the removed enclosure at Purchaser’s request at the time of removal.

Specific considerations:
  • Any special costs for fabrication and transporting glass where we do not have accessibility to, stairs or an elevator will be at Purchaser’s expense.  (Example: Lift; Scaffolding)
  • All shower doors and enclosures provided by the Company are custom ordered and fabricated for only the Purchaser’s opening(s) specifications. Once the Purchaser signs for the approval of the proposed design and sizes, these specifications are sent to our supplier to be custom made for the Purchaser. Following this, no alterations can be made.
  • On some occasions, mitered glass doors that are mounted to or close to an angled wall can only be opened one way depending on the layout of the opening.
  • All handles, hooks, and towel bars will be installed at our standard height unless otherwise instructed by the Purchaser in writing within the Company’s proposal or invoice.
  • Towel bars and hooks are optional and will be provided at the Purchaser’s request and must appear on the signed proposal or invoice. Units without a header may appear flimsy and can create movement or “FLEX” while opening and closing the door.
  • The Company will not be responsible for any structural changes after final measurements have been taken. All additional manufacturing and material costs due to alterations will be charged to the Purchaser. All defects in the glass and hardware that exceed industry standards such as scratches, chips, etc., must be acknowledged within 24 hours of installation and the Purchaser must email photos of said defects to the Company.
  • Small hair-like scratches are common, as well as dot-like spots embedded within the glass. The Purchaser acknowledges that these flaws may be visible at any time, especially when there is a window inside the shower or room. 

Warranties and Maintenance

Claims

All warranty claims are subject to inspection by the Company.

If any hardware fails or discolors within one year of the initial installation or receipt of goods, it will be replaced at no charge to the Purchaser. If any hardware fails or discolors after one year of the initial installation, there will be no charge for the hardware, however, the Purchaser will be responsible for a service charge at a minimum of $125.00 depending on the length of time to repair and the location of the job site. Warranty shall not exceed three years from the time of purchase.

Hard coat finishes on hardware may vary from selections due to materials used. Hardware is made of brass and headers are made of steel and aluminum. Finishes may vary from time to time or have a different shade due to the use of different materials used per application. This is to be expected and not covered under warranty.

Maintenance

Never use an abrasive cleaner such as Comet on the hardware. Many of the components are coated with a clear lacquer that will be damaged if subjected to harsh, abrasive cleaners, or chemicals. Drying the hardware with a clean, soft towel daily is the best way to maintain it. If mineral deposits form on the hardware, a solution of a few drops of liquid soap such as Ivory or similar mixed with a cup of warm water should be used to clean the hardware using a soft nonabrasive cloth. Rinse thoroughly with clean, warm water and dry. 

Due to the inherent nature of brass, the Company does not warranty any polished brass finishes. 

Hinges are greased at the factory for a quiet trouble-free operation. If squeaking occurs after installation, we suggest using a small amount of 3-and-1 oil.  Do not use any lubricating sprays such as WD-40.

There is no warranty on glass damage and/or breakage.

If any hardware or glass becomes loose or needs adjustment within one year of the installation by the Company, we will repair it at no charge to the Purchaser. After one year the Purchaser will agree to pay a minimum service charge of $125.00 depending on the length of time to repair and the location of the job site. 

The Company warranties leaks on its installations around fixed glass panels for one year.  If a leak occurs after one year, the Purchaser will be subject to a minimum service fee of $125.00. 

Please be advised that mold can occur from unclean or stagnant water.  The Company is not responsible for any mold growing in silicone caulk, nor tile.
